Rights of the Working Mother

Becoming a mother is a very exciting time in the life of any woman. Along with all of the changes that her body is undergoing she must also deal with changes in other areas of her life including work. After a woman gives birth and decides to return to work, she should be aware of her rights as a working mother.

Naturally the type of work that a woman does will have an impact on her individual rights within the workplace. There are some general rights of the working mother though and when a woman is fully aware of these she can better understand what is expected of her and also what she can expect from her employer.

Some common rights of working mothers include:

· Employment after maternity leave. When a woman takes time off work to have a baby she must be guaranteed that her current position or a comparable position will be awaiting her upon her return. The company she is working for cannot simply hire someone else on a long-term basis to fill her position unless they are planning on placing her in a similar position when she returns to work.
· To be free of discrimination. When a woman returns to work after the birth of her child she has the right to an environment that is free of discrimination. In other words, just because she has become a parent does not mean that her status as an employee changes. She should still be eligible for any promotions that she was eligible for before her pregnancy. She cannot be passed up for opportunities because she is a mother.
· Flexibility in her work schedule. A working mother is often the one who is most responsible for the care of the child. If the child becomes ill or needs to attend a medical appointment the working mother is often the person providing that care. Therefore she is entitled to time allowances, which make it possible for her to attend to her child in the case of an emergency.

The rights of the working mother apply in situations that involve both a biological child as well as an adoptive child. In the case of an adopted child, the mother should be granted leave so that she can spend the same amount of time with her child as a biological mother would following the birth. It’s vitally important that all working mothers understand their rights in relation to their position as a parent.
